UK Government Introduces Groundbreaking Procurement Act 2023

The UK Government has announced the implementation of the Procurement Act 2023, a transformative piece of legislation set to revolutionise public procurement processes across the construction industry.

The Act introduces several key measures aimed at enhancing transparency, promoting fair competition, and driving innovation:

  • Enhanced Transparency: New regulations will ensure greater transparency in public procurement, making it easier for smaller suppliers and subcontractors to compete.
  • Debarment List: A debarment list will be established to prevent underperforming subcontractors from applying for contracts, ensuring higher standards and accountability.
  • Commercial Freedom: Main contractors will have increased freedom to design procurement processes tailored to their specific needs, fostering innovation and efficiency.
  • Value-Based Selection: The Act encourages the selection of the most advantageous tender, considering factors such as local employment and reduced carbon emissions, rather than just the lowest price.
  • Support for SMEs: Measures to level the playing field for smaller suppliers will provide them with better opportunities to win contracts.

The Procurement Act 2023 proposes to be a significant step towards a more efficient, fair, and innovative construction industry in the UK. The Government claims to be committed to supporting the industry through this transition and ensuring that the benefits of the new legislation are realised.
